Inheritance

Many people who are entitled to an inheritance are deprived of what the deceased person meant to give them because the executor or administrator of the estate either wrongfully or negligently handled the estate. New Jersey law allows an executor or administrator, once appointed, to act on their own to identify and collect the assets, pay the estate debts, file any tax returns or other required documents and pay out to beneficiaries their inheritance. This means that there is no Court or other supervision of this person! The law imposes certain obligations upon executors and administrators and many times they simply fail to perform these obligations Because of this beneficiaries may receive only a portion of their inheritance or none at all. Specifically, this may happen because:

•    The executor has wrongfully used or taken the assets.
•    The executor has negligently dealt with the assets and they have either been lost or their value diminished.
•    The executor simply does not want to pay out the assets.
•    The executor refuses to try to locate all the assets.
•    The executor deals unfairly with one or more beneficiaries to the advantage of other beneficiaries.
•    The executor is also a beneficiary and takes action to his or her advantage.
